License

iOS. Your license to use the iOS App is governed by Apple's Standard EULA and App Store usage rules. If these terms conflict with the Standard EULA about that license, the Standard EULA controls.

Android. The Google Play Terms of Service apply to downloading the App and to purchases made through Google Play. For the Android App, these terms are the end-user license agreement: we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Android devices you own or control, for your own personal journaling and reflection, subject to these terms and Google Play's rules.

What the App is — and isn't

Wax & Wane is a journaling and reflection app. It uses astronomical calculations and astrological tradition as prompts for self-reflection. Readings, insights, tarot reflections and the Year Ahead are for reflection and enjoyment. They are not predictions and are not medical, psychological, legal or financial advice. Don't rely on them for important decisions. Astronomical positions are calculated on your device and are accurate for reflective use, not for navigation or scientific work.

Your content

You own what you write. It is stored on your device, and you are responsible for keeping it, for example through your device's backups or the App's export. We do not hold copies and cannot restore lost or erased data. If you share an image or a Kindred link, you are responsible for choosing who receives it.

What's free

The App is free to download and use, with unlimited journal pages. Free features include the nightly rite, mood check-ins, the daily reading, one tarot card each day, your natal chart and the meaning of each placement, the moon calendar, moods by moon phase, the new-moon recap, rituals, Kindred pairing, one sealed letter at a time, progress and rewards, widgets and notifications. We will not move a feature you already have for free behind a purchase.

The Almanac

The Almanac is an optional upgrade. It adds the full Year Ahead; a deeper nightly reading that includes up to three personal transits; pattern insights (your brightest and heaviest moon phases and signs, and how you felt during Mercury retrograde); explanations of every aspect in your chart; unlimited sealed letters; a night-early look at tomorrow’s omen; the moon read through the houses of your chart in Look Up; and the pearl and obsidian seal finishes. It is offered as:

• Yearly — auto-renewing, US base price $29.99 per year, with a 7-day free trial for eligible new subscribers.
• Monthly — auto-renewing, US base price $4.99 per month.
• Lifetime — a one-time purchase, US base price $69.99, that does not renew or expire for as long as we offer the App.

The localized price and terms shown by the App Store or Google Play before you confirm control your purchase. Local prices may differ from the US base prices above.

The Year Ahead (one-time)

The full Year Ahead is included in the Almanac. A separate one-time purchase is not currently available. Its cover, keynote and current-month pages are free.

Subscriptions, trials and cancellation

Payment is charged to your Apple or Google Play account when you confirm the purchase, or when a free trial ends. Subscriptions renew automatically at the then-current price unless cancelled before the renewal date. On the App Store, cancel at least 24 hours before the end of the current period, because your account may be charged for the renewal within the 24 hours before the period ends; on Google Play, cancel before the renewal date (to avoid being charged after a free trial, cancel before the trial ends). If you buy a subscription during a free trial, any unused part of the trial ends. Free trials are limited to one per store account.

You can manage or cancel subscriptions in your store account at any time — on iPhone: Settings → your name → Subscriptions; on Android: Google Play Store app → your profile icon → Payments & subscriptions → Subscriptions → Wax & Wane. Uninstalling the App does not cancel a subscription. Cancelling stops future renewals and takes effect at the end of the period you have paid for.

Refunds. Purchases are processed by the store, not by us. App Store refunds are requested from Apple (reportaproblem.apple.com) under Apple's policies. Google Play purchases follow the Google Play refund policy: within about 48 hours of purchase you can usually request a refund directly from Google Play; after that, contact us and we will help where Google's process allows. Nothing here limits refund rights you have under applicable law.

Acceptable use

• Don't copy, sell, rent, sublicense or redistribute the App or its content.
• Don't reverse engineer, decompile or attempt to extract source code except where that restriction is prohibited by law.
• Don't tamper with the App, its purchases or its rewards, or use it unlawfully or in violation of the store's terms.

Intellectual property

The App, including its code, writing, illustrations, tarot artwork, sounds and name, is owned by BlackRaven AI LLC and protected by intellectual-property laws. Birthplace data is from GeoNames, used under the Creative Commons Attribution 4.0 license. These terms don't transfer ownership to you.

Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the App will be uninterrupted or error-free, or that data stored on your device will not be lost.

Limitation of liability

To the maximum extent permitted by law, BlackRaven AI LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data or profits, arising from your use of the App. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us for the App in the past 12 months or USD $10.

Termination

You may stop using the App at any time by uninstalling it. We may suspend or end the App or your access if you breach these terms or if we discontinue the App. Sections about ownership, disclaimers, liability and governing law survive termination.

Governing law

These terms are governed by the laws of Wyoming, United States, without regard to its conflict-of-laws rules. Nothing here limits consumer-protection rights you have that cannot be waived under the law where you live.

Changes to these terms

We may update these terms. If we do, we'll change the date above and post the new version at this address. Changes won't apply retroactively to purchases you have already made.
